Copyright and Image Use Policy
Last updated: 26 July 2026
Copyright ownership
Unless expressly stated otherwise, all original photographs, artworks, photographic edits, composites, illustrations, videos, written content, graphics and other original creative material published on this website are protected by copyright and are owned by:
© 2026 Andrej Horníček. All rights reserved.
No copyright, ownership interest, licence or other intellectual property right is transferred to any person merely because content is displayed publicly, accessed through this website, shared through a link, supplied as a preview, or made available through social media.
The absence of a visible watermark, copyright symbol, signature, credit line or embedded metadata does not mean that an image is unprotected, free to use, in the public domain or available under a Creative Commons licence.
Permitted access
You may:
View content through this website for your own private, non-commercial enjoyment.
Share a direct link to the webpage on which an image appears.
Use content where Andrej Horníček has provided prior, express written permission specifying the permitted use.
Any permission or licence applies only to the specific image, user, purpose, territory, platform, duration and format expressly approved. Permission granted for one use does not authorise any other use.
Uses requiring prior written permission
Except where expressly permitted by applicable law, you must not download, save, screenshot, capture, copy, reproduce, publish, repost, distribute, transmit, display, print, sell, license, sublicense, upload or otherwise use any photograph or other protected content from this website without prior written permission from Andrej Horníček.
This prohibition includes, without limitation:
Posting an image on Instagram, Facebook, Pinterest, TikTok, X, Reddit, forums, blogs, websites, marketplaces or other social platforms.
Using an image in advertising, marketing, editorial content, news media, publications, presentations, portfolios, exhibitions, competitions, product listings or promotional material.
Using an image on merchandise, prints, posters, clothing, packaging, books, magazines, calendars, digital products, templates, stock-image services or non-fungible tokens.
Cropping, recolouring, retouching, filtering, compositing, tracing, animating, manipulating or creating an adapted version of an image.
Removing, obscuring, altering or falsifying a watermark, signature, credit line, copyright notice, filename or rights-management metadata.
Copying an image from a search engine, social media preview, cached page, thumbnail, embedded post or third-party website.
Hotlinking, framing, embedding or otherwise displaying an image directly from this website on another website, application or service.
Supplying an image to another person, organisation, publication, platform or client, whether free of charge or in return for payment or another benefit.
A credit, tag, mention or link does not replace the requirement to obtain permission. Attribution alone does not make an unauthorised use lawful.
Artificial intelligence, scraping and dataset use
No permission or licence is granted to use content from this website for:
Training, fine-tuning, testing, evaluating or improving an artificial intelligence or machine-learning system.
Generative AI training, image generation, style imitation, model evaluation, retrieval systems or synthetic-data creation.
Text and data mining, dataset creation, computer-vision research, facial or object recognition, embedding generation or automated content analysis.
Providing prompts, reference images, control images, image embeddings or other inputs to an AI system for the purpose of reproducing, adapting, approximating or imitating any photograph or its protected visual expression.
Automated scraping, crawling, harvesting, extraction, bulk downloading, archiving or collection.
Ordinary search-engine indexing is permitted only where the search engine complies with this website’s robots.txt file, metadata, access controls and other machine-readable instructions.
Any machine-readable reservation of rights published through this website must be treated as an express reservation of all available rights.
No implied licence
A licence will not arise through:
Silence or failure to respond to a request.
Previous correspondence or informal discussion.
Previous permission relating to another photograph or another use.
The receipt of a digital file.
The availability of a high-resolution image.
Publication on this website or on social media.
A previous repost that was not challenged.
Payment for a physical print, unless reproduction rights are expressly included in writing.
Purchasing or possessing a print, file or other copy of an artwork does not transfer copyright or grant reproduction, publication or commercial-use rights.
Moral rights
Andrej Horníček expressly asserts the right to be identified as the author of the photographs and other qualifying works under sections 77 and 78 of the Copyright, Designs and Patents Act 1988.
Andrej Horníček also reserves the right to object to derogatory treatment of qualifying works under section 80 of that Act, including prejudicial alteration, distortion or manipulation.
No waiver of moral rights is given unless expressly stated in a written agreement.
Licensing requests
To request permission or obtain a licence, use the contact form provided on this website before using the relevant content.
A request should identify:
The exact image or images.
The intended use.
The publication, organisation, client or account involved.
The platforms and territories on which the image will appear.
The proposed publication period.
Whether the use is commercial, promotional, editorial or personal.
The required dimensions, resolution and file format.
No use is authorised until written permission has been issued and any applicable licence fee and conditions have been agreed.
Unauthorised use and enforcement
Unauthorised use may constitute copyright infringement and, depending on the circumstances, infringement of moral rights, breach of contract, breach of confidence, passing off or another legal wrong.
Where unauthorised use is discovered, Andrej Horníček may:
Preserve evidence of the infringement.
Contact the user, publisher, client, hosting provider, platform, search engine, advertiser or payment provider.
Submit copyright infringement and takedown notices.
Require removal, correction, attribution or disclosure of information concerning the use.
Seek payment reflecting the relevant licensing value, losses, expenses and benefits obtained from the use.
Seek damages, an account of profits, delivery up, destruction of infringing material, costs, interest, an injunction or any other remedy available under applicable law.
Removing content after receiving a complaint does not retrospectively authorise the earlier use or prevent action concerning that use.
Nothing in this policy creates an automatic fine, penalty or predetermined debt. Any claim or remedy will be determined according to the applicable law, evidence and circumstances.
Reporting suspected infringement
Suspected unauthorised use may be reported through the contact form on this website. Reports should include the location of the material, screenshots where available, the date it was observed and any information identifying the person or organisation responsible.
Legal exceptions
Nothing in this policy is intended to prevent an act that is expressly permitted by applicable copyright law and that cannot lawfully be restricted by contract.
The person relying on a copyright exception is responsible for ensuring that every legal requirement of that exception is satisfied. The fact that a use is educational, personal, non-commercial, transformative, credited or published without profit does not automatically make it lawful.
Governing law
This policy and any dispute arising from the access to or use of content owned by Andrej Horníček are governed by the laws of England and Wales, subject to any mandatory law that applies otherwise.
The courts of England and Wales shall have jurisdiction over disputes, except where applicable law requires another court or jurisdiction.
Reservation of rights
All rights not expressly granted in writing are reserved.
